The following Terms and Conditions also contain the statutory information on your rights pursuant to the provisions governing distance selling contracts and electronic commerce.


1. Scope and Provider

These Terms and Conditions apply to all orders placed by consumers (§ 13 German Civil Code – BGB) via the online shop of pro-organic UG (limited liability), Weststraße 38, 52074 Aachen, Germany.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activity.

3. Conclusion of Contract

(1) You may select clothing items or goods from our product range and collect them in a so-called shopping cart using the “Add to cart” button. By clicking the “Place order with obligation to pay” button, you submit a binding offer to purchase the goods contained in the shopping cart. Before submitting the order, you may review and change your details at any time. However, the order can only be submitted if you accept these Terms and Conditions by clicking the “Accept Terms and Conditions” button and thereby include them in your offer.

(2) We will then send you an automatic order confirmation by email, in which your order is listed again and which you can print using the “Print” function. This automatic confirmation merely documents that your order has been received by us and does not constitute acceptance of your offer. The contract is only concluded when we issue an acceptance declaration, which is sent in a separate email (order confirmation). In this email, or at the latest upon delivery of the goods, we will send you the contract text (consisting of the order, Terms and Conditions and order confirmation) on a durable medium (email or paper printout) (contract confirmation). The contract text is stored in compliance with data protection regulations.

(3) The contract is concluded in the German language. You may view these Terms and Conditions at any time on this page. If you have created a customer account, you can view your customer data at any time under “Your Account”.


4. Delivery, Availability of Goods

(1) Delivery times stated by us are calculated from the time of our order confirmation, provided that payment of the purchase price has been made in advance (except in the case of purchase on account). Unless otherwise stated for the respective product in our online shop, the delivery time is 3–5 days. Any deviating delivery times are indicated on the respective product page. Subject to the provisions of paragraph (2) below, the delivery period begins on the date the contract is concluded.

(2) If there are justified indications of a risk of non-payment, we reserve the right to deliver only after receipt of the purchase price including shipping costs (advance payment reservation). If we make use of this reservation, we will inform you immediately. In this case, the delivery period begins upon full payment of the purchase price and shipping costs.

(3) If no copies of the product selected by the customer are available at the time of the order, we will inform you of this immediately in the order confirmation. If the product is permanently unavailable, we will refrain from issuing an acceptance declaration. In this case, no contract is concluded.

(4) If the product specified in your order is only temporarily unavailable, we will also inform you of this immediately in the order confirmation.

(5) The following delivery restrictions apply: We only deliver to customers whose habitual residence (billing address) is located in one of the following countries and who can provide a delivery address in the same country: Federal Republic of Germany. Delivery is carried out via DHL. In addition, from 1 August 2025, we also deliver to the Netherlands and Belgium.


5. Prices and Shipping Costs

(1) The prices stated on the product pages include statutory VAT and other price components and are exclusive of shipping costs.

(2) In addition to the stated prices, we charge a flat shipping fee of EUR 5.90 per order for deliveries within Germany for orders with a value of less than EUR 120.00. Vouchers issued by us are not applicable to shipping costs unless they are vouchers for free shipping. For orders with a value of EUR 120.00 or more, delivery within Germany is free of charge. Shipping costs are displayed again on the product pages, in the shopping cart system and on the order page. Customers outside Germany pay a flat shipping fee of EUR 13.50 and are responsible for the return shipping costs themselves. We recommend insured shipping.

(3) If payment is made by cash on delivery, an additional transfer fee of EUR 2.00 is payable, which is collected by the delivery agent on site. No further taxes or costs apply.

(4) In the event of withdrawal, customers in Germany must bear return shipping costs of EUR 3.00. Customers outside Germany bear the full return shipping costs themselves.


6. Payment Terms

(1) Payment can be made by PayPal, Klarna, credit card or advance payment.

(2) If advance payment is selected, we will provide our bank details in the order confirmation. The invoice amount must be transferred to our account within 14 days. Please state your order number as the reference for advance payments so that we can allocate the payment correctly.

(3) When using the PayPal and Klarna payment services, the respective terms and conditions of these providers apply.

(4) As a buyer, you may only exercise a right of retention insofar as your counterclaim arises from the same purchase contract.


7. Retention of Title

The goods remain our property until full payment has been made. Before ownership is transferred, pledging, transfer by way of security, processing or modification without our consent is not permitted.


8. Warranty

(1) We are liable for material or legal defects of delivered goods in accordance with the applicable statutory provisions, in particular §§ 434 et seq. of the German Civil Code (BGB). The limitation period for statutory warranty claims is two years and begins upon delivery of the goods.

(2) If goods are delivered with obvious transport damage, please report such defects immediately to the delivery agent and contact us as soon as possible. Failure to report or make contact has no consequences for your statutory warranty rights. However, it helps us to assert our own claims against the carrier or transport insurance.

(3) Any additional warranty for goods delivered by us only exists if this has been expressly stated in the order confirmation for the respective item.
